Terms and Conditions

Welcome to SOMATO INDIA PVT LTD, a leading manufacturer of high-quality laptops. These Terms and Conditions (“T&C”) govern the sale and use of SOMATO laptops and related products and services (“Products”). By purchasing or using the Products, customers (“Customers”) agree to be bound by these T&C.

 

1: Definitions

1.1 “SOMATO” refers to SOMATO India Pvt Ltd, a company incorporated under the laws of India.
1.2 “Products” include SOMATO laptops, accessories, and software.
1.3 “Customer” refers to the individual or organization purchasing or using the Products.
1.4 “Order” refers to the customer’s purchase order for the Products.

 

2: Warranty and Liability

2.1 SOMATO warrants that the Products will be free from defects in materials and workmanship for a period of 2 years from the date of delivery.
2.2 SOMATO’s liability for damages or losses resulting from the use of its Products is limited to the purchase price of the Product.
2.3 SOMATO is not liable for any consequential damages, including loss of data, business interruption, or other indirect losses.

 

3: Payment and Pricing

3.1 Customers must pay for the Products in accordance with SOMATO’s payment terms, which include online payment, credit/debit card, and bank transfer.
3.2 SOMATO reserves the right to change its pricing policies at any time, without notice.
3.3 All prices are inclusive of applicable taxes and duties.

 

4: Return and Refund Policies

4.1 Customers may return or exchange Products within 7 days from the date of delivery, subject to a restocking fee of 10% of the purchase price.
4.2 Refunds will be processed within 14 days from the date of return.
4.3 Customers must obtain a Return Merchandise Authorization (RMA) number from SOMATO before returning any Product.

 

5: Intellectual Property

5.1 SOMATO retains all intellectual property rights in its Products, including copyrights, trademarks, and trade secrets.
5.2 Customers may not reproduce, modify, or distribute SOMATO’s intellectual property without prior written consent.

 

6: Data Protection

6.1 SOMATO collects and stores customer data in accordance with applicable data protection regulations, including the Information Technology Act, 2000, and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.
6.2 Customers consent to SOMATO’s use of their data for marketing and other purposes, as outlined in SOMATO’s privacy policy.

 

7: Governing Law and Jurisdiction

7.1 These T&C will be governed by and construed in accordance with the laws of India.
7.2 Any disputes arising from these T&C will be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996.

 

8: Termination and Cancellation

8.1 SOMATO may terminate or cancel a customer’s account or order at any time, without notice, if the customer breaches these T&C.
8.2 Upon termination or cancellation, customers must cease using the Products and return any SOMATO property.

 

9: Amendments and Updates

9.1 SOMATO reserves the right to modify or update these T&C at any time, without notice.
9.2 Customers will be notified of changes through SOMATO’s website or email.

 

10: Entire Agreement

10.1 These T&C constitute the entire agreement between SOMATO and the customer, superseding all prior or contemporaneous agreements.
10.2 These T&C may not be amended or modified except in writing signed by both parties.

 

11: Severability

11.1 If any provision of these T&C is held invalid or unenforceable, the remaining provisions will remain in effect.

 

12: Customer Obligations

12.1 Customers must comply with all applicable laws and regulations when using the Products.
12.2 Customers must not use the Products for any unauthorized or unlawful purpose.

 

13: Warranty Disclaimer

13.1 SOMATO disclaims all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
13.2 SOMATO does not warrant that the Products will meet the customer’s requirements or expectations.

 

14: Limitation of Liability

14.1 SOMATO’s liability for damages or losses resulting from the use of its Products is limited to the purchase price of the Product.
14.2 SOMATO is not liable for any consequential damages, including loss of data, business interruption, or other indirect losses.
